New York Leave & Benefits at a Glance — 2026

Quick answer: In 2026, New York Paid Family Leave (PFL) pays 67% of your average weekly wage, up to $1,228.53 per week, for up to 12 weeks — a maximum total of $14,742.36. New York Disability Benefits (DBL) pays 50% of your average weekly wage, up to $170 per week, for up to 26 weeks. DBL and PFL cannot be paid in the same week, and combined they are limited to 26 weeks in any 52-week period. These are the official 2026 rates based on the New York State Average Weekly Wage (NYSAWW) of $1,833.63, verified against the NYS Workers' Compensation Board and the NYS Paid Family Leave program.

Eligibility: Full-time employees qualify for PFL after 26 consecutive weeks (20+ hours/week); part-time employees qualify after 175 days worked. DBL covers most private-sector employees after 4 consecutive weeks (full-time) or 25 days (part-time). Self-employed workers can voluntarily opt into both programs. New York City employees should also check NYC's own leave rules — Paid Safe & Sick Leave and, for large employers, the new NYC Paid Caregiver Leave.
