Does NYC have a local income tax on top of New York State tax?
Yes. New York City residents pay a NYC personal income tax on top of New York State income tax, and Yonkers residents pay a Yonkers income tax. If you live outside NYC but work in the city, you generally do not owe NYC personal income tax — but your employer still withholds New York State tax on your wages. How do I set up New York withholding for a new employee?
New York uses Form IT-2104 (Employee's Withholding Allowance Certificate). The employee completes it to claim allowances and state exemption status, and your payroll system withholds NYS income tax using the current withholding tables. Keep the completed form in the employee's payroll file — it stays in effect until the employee submits a change.
How is overtime calculated under New York law?
New York generally requires time-and-a-half (1.5x) for hours worked over 40 in a workweek, consistent with both the New York State Labor Law and the federal FLSA. Some industries have specific additional rules. Yes. New York Paid Family Leave (PFL) and Statutory Disability Benefits (DBL) are funded through payroll deductions. The contribution rate and maximum annual deduction are set by the state each year and appear as separate line items on your pay stub. What limits apply to wage garnishment in New York?
For most consumer debts, New York law (CPLR §5231) caps an income execution at 10% of gross wages and also limits it so the employee keeps at least 30 times the state or federal minimum wage each week — whichever is lower.
